Croatia legally regulates remote work: How will it function?

Work from home in Croatia will now also be regulated by law. From the beginning of 2023, a worker in Croatia can ask an employer to change the contract due to remote work, and work on Sundays must be paid 50 percent more, while in Serbia the fixed salary increase on Sundays is not recognized.

From the beginning of 2023, in order to reconcile work, family obligations and personal needs, an employee in Croatia can request from an employer a change to the employment contract, which would stipulate that he/she can work for a while in a separate place due to health protection, disability, pregnancy or obligations towards children up to the age of eight, or in order to help a family member who is sick.

The new Croatian Labour Act actually regulates work from home, remote work and work through digital platforms and it defines a new way of performing permanent seasonal jobs, which also include work for an indefinite period of time. The local media recall that by amending the law, work at a separate place takes place at home or in another area with a similar purpose, which is determined by the agreement between the worker and the employer, and remote work is always done exclusively through information and communication technology.

The new act also regulates that in the event of epidemics, earthquakes or floods, an employer may approve an employee to work from home, for a maximum period of 30 days.
