    Gifts for doctors worth EUR 460 – the law says this is NOT CORRUPTION

    According to the provisions of the new Healthcare Act, medical workers in Serbia are allowed to receive from their patients non-cash gifts whose individual value does not exceed RSD 2,726 and whose total value does not exceed the average net salary of RSD 54,521.
    The recently adopted law states that it is not considered corruption or conflict of interest if a person „expresses gratitude in the form of gifts of low value, advertising material and samples, which do not include cash, and whose individual value does not exceed 5 percent of an average monthly salary excluding taxes and contributions in the Republic Serbia, and whose total value does not exceed the full amount of an average salary“.
    An average net salary excluding taxes and contributions (net) for January 2019 amounted to RSD 54,521 (EUR 462).
    However, the law does not specify to what period of time the total value of the gifts given by a patient to medical workers refers.
    The law defines that a healthcare worker and a member of a committee in a healthcare institution, as well as members of their immediate families must not demand or receive money, gifts, services or any other benefits for themselves, members of their immediate family or natural and legal persons who can reasonably be connected with them in terms of joint interest, which may affect impartiality or professional performance of duties, i.e. which can be considered an award in connection with the performance of duties and the performance of healthcare activities.
