    Draft law: Moving forward, workers hired via agencies to receive employment contract

    The Ministry of Labour has published a Draft Law on Agency Employment that foresees that in future all workers working through via agency („employee leasing“) will have an employment contract and same working conditions as full-time employees, while company can lease up to 30 percent of the workforce from the total number of workers.

    However, this law does not apply to workers who work via student and youth cooperatives and companies providing services to enterprises, such as cleaners and security personnel who can work under a temporary and casual employment contract without the right to annual and sick leave, web portal “Radnik” reports.

    „The agency concludes a permanent placement or fixed-term employment contract with the leased employee,” the Draft Law on Agency Employment stipulates.

    This means that, if this draft law becomes final as well, workers hired through temporary employment agency will have a permanent placement or fixed-term employment contract with the agency, but not other work engagement contracts.
