Businessman, admit and you shall be forgiven

If they commit a violation in the field of labour or trade, businessmen in Serbia may sign an agreement with the inspectorate on admitting the violation and thus halve the penalty. The same goes for the violations of traffic regulations.

Admission of a violation can be applied immediately at the market and labour inspection department, but many businessmen are not aware of this possibility, so they do not use it, Minister of State Administration and Local Self-Government, Branko Ruzic, has told the Vecernje Novosti daily.

According to him, this is a tool for „good economy“, because the reduction of the penalty for offenses develops a partnership relationship with good economy, and repressive mechanisms should, in his opinion, be reserved for those who are consciously in the grey zone.

This will also relieve misdemeanour courts, which will automatically become more efficient in resolving other cases.

The offenses for which penalties can be halved, and which fall under the competence of the market inspection, include the sale of goods outside the point of sale, without a declaration, if a businessman does not keep turnover records in a complete and proper manner, if he/she does not display prices or opening hours or if he/she does not adhere to them.

Regarding labour inspection, these offences include, among others, cases when a businessman fails to adopt a redundancy program, he/she determines overtime work contrary to the Labour Act, he/she does not allow the use of paid leave.
