Loan processing is (not) a permitted cost

The legal standpoint of the Supreme Court of Cassation (VKS) on the permissibility of contracting loan costs is interpreted differently by banks and the representatives of the Citizens’ Association Efektiva.

Secretary General of the Association of Banks, Veroljub Dugalic, has said that the position of the VKS is that banks have the right to collect the costs of processing a loan precisely because of the different practice that so far existed in the first instance courts when it comes to the lawsuits of clients against banks.

After the announcement of the standpoint of the Supreme Court of Cassation, all courts received instructions on how to handle these cases in the future, Dugalic told TV Prva, noting that there are about 7,000 citizens’ complaints against banks. „They will all be rejected, and all those costs will eventually be paid by citizens“, Dugalic believes.

Asked about the attorneys urging citizens to sue banks, Dugalic says that only lawyers benefit in this case, and that „the lawyers’ lobby“ actually persuaded citizens to sue banks. „Our advice is the following – since citizens will lose these disputes, lawyers should pay for those expenses, as well as those who urged them to sue the banks,“ Dugalic said.

According to him, citizens should not listen to the advice of those who lied to the public and misled them, such as various associations and „self-proclaimed experts and analysts“ who urged them to sue the banks. He stated that before taking a loan, citizens should get acquainted with the terms of the contract.

Dugalic says that a bank has the right to charge the costs of processing a loan under a contract with the client, and that the NBS has not prohibited such practice, not does it have the authority to prohibit it, but it just tried to standardise these costs through a letter sent to banks.
