Civil enforcement officers will no longer be able to „seize“ two thirds of the salary?

Civil enforcement officers might be forced in the future to charge up to half of the salary or pension at most, instead of the current two-thirds.

This is one of the solutions offered by the Work Group of the Ministry of Justice that is in charge of amendments of the Law on Enforcement and Security. Bearing in mind that certain, not so small number of debtors, to whom two-thirds of the salary or pension are deducted based on debts, is not able to secure a minimum income standard, the Work Group is considering the possibility to move the census from two thirds to half of the income, Ministry of Justice reports.

Another major novelty is establishment of an e-Auction platform.

This means that each sale of immovable property by the civil enforcement officer will be organized online. The introduction of this method of sale of debtor’s immovable property leads to a more transparent procedure, reducing the possibility of misuse, and secures equitable procedure for sale of immovable property, the Ministry announced.
